1. Agreement
By creating an account, accessing Nestree, or using the service on behalf of an organization, you agree to these Terms of Service, the Privacy Policy, and the Data Processing Addendum where it applies.
If you use Nestree for an organization, you represent that you are authorized to accept these terms for that organization.
2. The service
Nestree is an AI-native, all-in-one CRM for managing contacts, companies, deals, tasks, marketing workflows, support tickets, exports, erasure, and assistive AI features.
Nestree is free to use at launch. A paid plan may be introduced later. We will not charge you unless you knowingly choose a paid plan or paid service.
3. Accounts and security
- You are responsible for keeping login credentials secure.
- You must provide accurate account information and keep it updated.
- You are responsible for activity under your workspace, including users you invite.
- You must promptly tell us if you believe an account or workspace has been compromised.
4. Customer data
You retain ownership of the data you or your users submit to Nestree. You grant Nest Digital Canada Inc. the rights needed to host, process, transmit, back up, secure, and display that data to provide Nestree.
You are responsible for having the rights, notices, consents, and lawful bases required to upload, process, email, export, or erase personal data through Nestree.
5. AI features
AI features are assistive. They may draft, summarize, enrich, classify, search, or suggest next actions, but outputs can be incomplete or wrong. You remain responsible for reviewing AI outputs before using them, especially before sending messages or making decisions about people.
Customer CRM data is not used to train foundation models. AI use is logged for audit, transparency, product safety, and cost control.
6. Acceptable use
- Do not use Nestree to violate law, privacy rights, intellectual-property rights, email rules, or anti-spam obligations.
- Do not upload malware, attempt unauthorized access, probe or bypass security controls, scrape the service, or interfere with service operation.
- Do not use Nestree for unlawful surveillance, harassment, discriminatory decisions, or high-impact automated decisions without proper human review and lawful basis.
- Do not send marketing campaigns without proper consent and required unsubscribe, sender, and identification information.
7. Proprietary rights
Nestree, including its software, design, brand, workflows, documentation, and product content, is proprietary to Nest Digital Canada Inc. Free to use does not mean open source. These terms do not grant rights to copy, resell, reverse engineer, or create derivative services from Nestree except as allowed by law.
8. Availability and changes
We work to keep Nestree reliable, but the service may be unavailable during maintenance, incidents, provider outages, beta changes, or events outside our control. We may add, change, suspend, or remove features as the product evolves.
9. Suspension and termination
We may suspend or terminate access if you breach these terms, create security risk, abuse the service, fail to comply with legal obligations, or use Nestree in a way that could harm Nestree, other users, or third parties.
You may stop using Nestree at any time. Export and erasure tools are available in the product, subject to legal, backup, audit, and security retention requirements.
10. Disclaimers and liability
Nestree is provided as-is and as-available to the fullest extent permitted by law. We do not guarantee that the service will be uninterrupted, error-free, or fit for every use. To the fullest extent permitted by law, Nest Digital Canada Inc. is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.
11. Governing law and contact
These terms are governed by the laws of Ontario and applicable federal laws of Canada, without regard to conflict-of-law rules.
